Referral Procedures of the Empire State Regional Council of Carpenters

In order to administer the referral system in a fair and equitable manner, having in mind the complex and varied classifications of carpentry work, and to establish records and procedures which will be adequate to disclose fully the basis on which each referral is made, the following rules have been promulgated.  All references herein to Council mean the Empire State Regional Council of Carpenters.

Jury Duty in the construction industry:

Under Judiciary law s 519, if an employer employs over 10 employees, the employer must pay the employee at least $40 dollars for the first three days.  After the third day. New York State pays the employee.  Thus, if a member was scheduled to work on a construction job, but is instead called to jury duty,  the contractor is required to pay a minimum of $40 dollars to that employee for the first three days of jury duty provided the contractor has more than 10 employees.  If the member is laid off or unemployed, New York state pays the $40 dollars per day.
